Nubis does not access, read, or process the proprietary application data or customer data that you store or process on our Infrastructure unless explicitly configured by you using managed services. You remain solely responsible for securing your applications, managing access controls, and complying with data protection laws, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other regional privacy mandates.
**For customers deploying infrastructure in European Union (EU) regions, Nubis implements Standard Contractual Clauses (SCCs) and Data Processing Agreements (DPAs) by default to facilitate the lawful transfer of personal data. However, you are responsible for assessing the adequacy of your data flows. While Nubis operates with zero-access encryption at rest for managed databases, full compliance requires your adherence to encryption-in-transit protocols and secure key management. ***Service Level Agreements (SLAs) apply strictly to the availability of the underlying Infrastructure. Nubis guarantees 99.99% uptime for core hypervisor and networking components in highly available (HA) deployments. SLAs do not cover downtime resulting from your misconfiguration, application-level memory leaks, operating system kernel panics, or Distributed Denial of Service (DDoS) attacks that exceed provisioned volumetric mitigation capacities. SLA credits are prorated and must be requested within 30 days of the incident. Please refer to the SLA terms at https://usenubis.com/legal/sla for details.

If you operate in highly regulated industries (e.g., healthcare under HIPAA, or finance under PCI-DSS), you must explicitly select compliant regions and configure services according to our compliance blueprints. Nubis takes no responsibility for your failure to isolate protected health information (PHI) or cardholder data (CHD) environments.
